Rise & Tide Event Indemnity and Waiver

PARTICIPANT INDEMNITY, WAIVER AND ASSUMPTION OF RISK

By entering and participating in any Rise & Tide event, including but not limited to Sunrise Runs, Moonlit Runs, Beach Runs, Walking Events, Fitness Challenges, and associated activities, I acknowledge and agree to the following:

1. Assumption of Risk

I understand that participation in physical activities and outdoor events involves inherent risks, including but not limited to falls, collisions, adverse weather conditions, uneven terrain, wildlife encounters, water-related hazards, illness, injury, permanent disability, and death. I voluntarily assume all risks associated with my participation.

2. Medical Fitness

I declare that I am physically and medically fit to participate in the event and have not been advised otherwise by a qualified medical practitioner. I accept full responsibility for monitoring my own health and wellbeing before, during, and after the event.

3. Release and Indemnity

To the fullest extent permitted by law, I release and hold harmless Rise & Tide, 5PFit, its directors, employees, volunteers, event officials, sponsors, partners, venue owners, landowners, municipalities, and any other persons or entities associated with the event from any claims, demands, damages, costs, expenses, losses, injuries, or liabilities arising directly or indirectly from my participation, except where caused by gross negligence or wilful misconduct.

4. Emergency Medical Treatment

In the event of an accident, injury, or medical emergency, I authorize the event organizers to obtain medical treatment on my behalf if necessary. I accept responsibility for all medical and related costs incurred.

5. Personal Property

I acknowledge that I am solely responsible for my personal belongings and equipment. The organizers shall not be liable for any loss, theft, or damage to personal property.

6. Compliance with Event Rules

I agree to follow all event rules, safety instructions, and directions given by event officials, marshals, volunteers, and emergency personnel. Failure to comply may result in my removal from the event without refund.

7. Photography and Media Consent

I grant Rise & Tide and its partners permission to photograph, record, and use images, video footage, and audio recordings of me for promotional, marketing, educational, and social media purposes without compensation.

8. Environmental Responsibility

I agree to respect the environment, wildlife, and surrounding communities. I will not litter and will conduct myself in a responsible manner throughout the event.

9. Cancellation and Force Majeure

I acknowledge that events may be cancelled, postponed, modified, or shortened due to weather conditions, safety concerns, natural disasters, government restrictions, or circumstances beyond the organizers’ control.

10. Minors

Participants under the age of 18 may only participate with the consent of a parent or legal guardian. By accepting this indemnity on behalf of a minor, the parent or guardian confirms that they have read and understood the contents and consent to the minor’s participation.

Declaration

I confirm that I have carefully read and understood this indemnity and waiver. I acknowledge that I am giving up certain legal rights by accepting it and that I do so freely and voluntarily.
